Governors of 35 states filed suit against Fed Government

(Via Email, 6/19, 2010, hat tip: Stella Guenther) The email asks to "[h]ave each person contact a minimum of twenty people on their Address list; in turn ask each of those to do likewise" to reach the 38-state minimum to convene a constitutional convention.

Proposed 28th Amendment to the United States Constitution: "Congress shall make no law that applies to the citizens of the United States that does not apply equally to the Senators and/or Representatives; and, Congress shall make no law that applies to the Senators and/or Representatives that does not apply equally to the citizens of the United States."

Note that Oregon already has a similar provision in its Constitution.
Oregon Constitution, Article 1, Section 20: "No law shall be passed granting to any citizen or class of citizens privileges, or immunities, which, upon the same terms, shall not equally belong to all citizens."

Subject: Governors of 35 states filed suit against Fed Government

Governors of 35 states have already filed suit against the Federal
Government for imposing unlawful burdens upon them. It only takes 38
(of the 50) States to convene a Constitutional Convention.

Really important! Hope you all do it!

This will take less than thirty seconds to read. If you agree, please
pass it on.

An idea whose time has come

For too long we have been too complacent about the workings of
Congress. Many citizens had no idea that members of Congress could
retire with the same pay after only one term, that they didn't pay into
Social Security, that they specifically exempted themselves from many
of the laws they have passed (such as being exempt from any fear of
prosecution for sexual harassment) while ordinary citizens must live
under those laws. The latest is to exempt themselves from the
Healthcare Reform that is being considered...in all of its forms.
Somehow, that doesn't seem logical. We do not have an elite that is
above the law. I truly don't care if they are Democrat, Republican,
Independent or whatever. The self-serving must stop. This is a good
way to do that. It is an idea whose time has come.

Have each person contact a minimum of twenty people on their Address
list; in turn ask each of those to do likewise.

In three days, most people in The United States of America will have
the message. This is one proposal that really should be passed around.

Proposed 28th Amendment to the United States Constitution
"Congress shall make no law that applies to the citizens of the United
States that does not apply equally to the Senators and/or
Representatives; and, Congress shall make no law that applies to the
Senators and/or Representatives that does not apply equally to the
citizens of the United States."

  1. This Post is typical of 99% of the fraudulent b.s. emails circulating online presently about the Obama Administration and for that matter, Congress. I find it incredulous that this is posted on the website of what appears to be a legitimate organization. the Benton County, Oregon Republican Women's Club.

It is frought with untruths, lies and innuendos. First off, ZERO Governors have filed suit against the Federal Government. That is the role of the Attorney Generals of states and thus far, only 11 Attorney Generals have done so.

Secondly, if anyone is actually politically involved or aware to any degree they would know that the information pertaining to Members of Congress being able to collect their full salarys after serving one term is untrue. Furthermore, Members of Congress have been required to pay Social Security Tax for 25 years now (Finally) and they are NOT exempt from the recently passed Healthcare Reform Bill.

The IGNORANCE of the American voting populace is frightening and to see this posted on a political party's official website is beyond comprehension. Who edits this site? Micky Mouse?

  5. Anonymous #1, You pointed out what was wrong about the posting, in your opinion, but you did not offer what you think is the correct information. How about "educating" us.

First, if you know of 11, which 11 do you know?

Second, after one term, what does a Member of Congress receive as a benefit and how long do you have to be a Member of Congress before you receive full salary?

Third, if members have to pay Social Security Tax, is it based on their Congressional pay and is it at the same rate as citizens?

Fourth, are you saying Congress does not have a health care plan of their own because your B.S. is getting pretty deep on this one.

And finally, we the IGNORANT voted you and your liberal anticapitalist/communist/socialist/George Soros loving kind into office and we will vote you out!

  8. I think I've found answers that Anonymous should have offered:

    First: http://www.reuters.com/article/idUSTRE62L3B820100322
"Ten of the attorneys general plan to band together in a collective lawsuit on behalf of Alabama, Florida, Nebraska, North Dakota, Pennsylvania, South Carolina, South Dakota, Texas, Utah and Washington."

    #11 is Virginia.

Second: This site may answer your questions?
    http://usgovinfo.about.com/od/uscongress/a/congresspay.htm

    Third: http://www.ssa.gov/history/hfaq.html
"there are still some Federal employees, those first hired prior to January 1984, who are not participants in the Social Security system. All other Federal government employees participate in Social Security like everyone else."

    Fourth: http://www.examiner.com/examiner/x-11804-Health-Care-Examiner~y2009m6d25-All-Americans-should-want-the-health-insurance-plan-Congress-has

"Section 3116 of the Affordable Health Choices Act specifically exempts member of Congress from the proposed health reform plan. It also exempts all federal employees."

You seem to be threatened by the Proposed 28th Amendment to the United States Constitution.

    Why? Where do you work?

  9. I happen to agree with #1 and #2 here. I am a Republican and yet bought into some of what Obama and initially preached. Hope, change, an uneducated promise to bring our troops home in 18 months without understanding the ramifications that may have or how realistic it may be...jobs, etc. We all want change, we want to see America's exports increase and see our own economy flourish again instead of being the leading exporter of foreign goods...we don't want to see American values and principals that this very nation has fought and died over...what we have stood for for so many years become a meer memory.

Our government can work...it has for this long...but we as American's need to take responsibility for and need to be aware of what is happeneing. We listen to the News...depending on the channel we get a different spin. We read the paper, again depends on the paper as to which side you get. It has always been this way...right down to the politics from our histroy books.

#1 is right...it is sad how many American's (perhaps not neccessarily those of us here reading this blog but many others) who elect officials just so that they do not have to be informed. They vote by what a guy says in a bunch of debates and some vote due to race or gender alone. What about a person's track record. Actions should speak louder than words.

If you want the facts...see below pasted from an article referecing fact check and other legally published legislation that any one of us has access to as United States Citizens...

    "Congressional retirement and Social Security
It's false that members of Congress can retire after only one term with full pay, and false that they don't pay into Social Security. Members elected after 1983 participate in the Federal Employees Retirement System. Members elected before 1983 participate in the older Civil Service Retirement Program. In both cases, they contribute to the plans at a slightly higher rate than ordinary federal employees. How much members of Congress receive upon retirement depends on their age, length of government service, and the configuration of their plan. All members of Congress pay into Social Security.

Immunity from prosecution for sexual harassment
Once upon a time, members of Congress were exempt from many of the employment and civil rights regulations under which private businesses operate, but no longer, thanks to the Congressional Accountability Act of 1995. Section 201 includes prohibitions against discrimination baded on race, color, religion, sex, or national origin, as well as sexual and other harassment in the workplace.

    Congressional health care coverage
It's false that Congress has exempted itself from the provisions of the various health care reform bills introduced in the House and Senate in 2009. According to an analysis by FactCheck.org: "Members of Congress are subject to the legislation’s mandate to have insurance, and the plans available to them must meet the same minimum benefit standards that other insurance plans will have to meet." "

I hope this answers some of those questiosn above. We are all entitled to our own ebliefs people...but the facts speak for themselves.

  16. For the record,US Senators and Congressmen have retirement plans just like any federal employee. Vested (though not fully) after five years of service. The average retirement pension for rank and file who retired after 2006 is about $35K.

  17. And in the white trunks is....

So where do I find out the truth about this one? Republican women of Benton, Oregon seem to think it's true, Anonymous #1 ( blogger on My Right Wing Dad) says it's totally false, anonymous #2 concurs, anonymouse #3 is either being ironic or can't spell; anonymous # 4: ditto. Anon #5 can spell but is a foamer. Polifact.com - which seems to be kinda neutral 'cause both Liberals & Conservatives think it's biased - doesn't rate this chain letter. Which I received from 2 sources. It looks dodgy to me, but what do I know?

  22. This was silly from the start. How is this chain email any different from the one I got the other day about the “Bat Boy” giving birth to Elvis’s evil twin? How can anyone take this stuff seriously, especially when no supporting evidence is presented? Others have provided links to the contrary. They choose to research the issue instead of believing something just because he or she got it via email. Yet, people in this thread still seem to want to rally behind it. I challenge the author, or supporters of this statement, to provide any legitimate proof. Otherwise, comments like that are a complete waste of everyone’s time.

We are in a tight spot as a nation and each side seems to be digging in their heels, while things fall apart around them. Instead of working towards a common goal, our government is locked in an infantile contest of tug of war. It is obvious that things are broke, and regardless of who caused it, we need to fix it. I realize that is not going to be an easy task, but it will not get any easier when people resort to Jerry Springer Show tactics instead of healthy intellectual debate. Everyone is afraid for the future, and that panic is what drives the success of chain emails like this. It is not helping, it is only making things worse.
